The European Union and/or the UN and/or Finnish authorities have imposed and may in future impose sanctions through legislation and/or decisions of their institutions with which the procuring entity is obligated to comply. Due to these sanctions and the decisions to freeze funds, the tenderer that submitted a tender in response to the invitation to tender (hereinafter ‘the Tenderer’) affirms to the procuring entity that:

a) no sanctions referred to above have been imposed on:

• the Tenderer;
• members of the administrative, management or supervisory body of the Tenderer or persons exercising control, representation or supervision power of the Tenderer;
• the Tenderer’s direct or indirect owners;
• subcontractors participating in producing the goods or providing the services under the contract that is the subject of the invitation to tender;
• members of the administrative, management or supervisory body of such subcontractors or persons exercising control, representation or supervision power of such subcontractors; and
• the direct or indirect owners of such subcontractors;

b) should the Tenderer’s tender be accepted, the Tenderer shall undertake to immediately notify the procuring entity if sanctions are imposed on any of the parties referred to in section (a) during the procurement contract period and to ensure that the Tenderer’s activities and the use of the goods produced or services provided by the Tenderer and its subcontractors will not violate the aforementioned sanctions during the contract period; and

c) the Tenderer shall, upon request and without delay, provide the procuring entity with information on its direct or indirect owners, subcontractors and other beneficiaries.
